Leaseweb entities operate in multiple jurisdictions pursuant to (local) applicable privacy laws, while taking into account the stringent requirements of the General Data Protection Regulation (“GDPR”).
Data Processing Agreements (DPA)
For the delivery of various IAAS Services as local Cloud Service Provider, the Leaseweb Sales Entity may act as processor. As a customer, you can find the Data Processing Agreement incorporated into Clause 8 of our local Sales Terms and Conditions per Leaseweb Sales Entity subject to local law, as part of their Sales Contract with Leaseweb.
Upon customer’s request and if appropriate for the specific Services, we are able to provide an additional separate DPA for customers’ recordkeeping or compliance purposes.

EU Standard Contractual Clauses and EU Adequacy Decisions
In addition, to EU-based customers doing business with Leaseweb Sales Entities outside of the EU, the following is applicable:
- EU-U.S. Data Privacy Framework (“DPF”)
Leaseweb USA Inc. has obtained the DPF certificate and adheres to the DPF principles. In addition, Leaseweb USA Inc. has also obtained the UK and Swiss extensions to the DPF. This means that customers subject to GDPR, UK GDPR or Swiss privacy laws are able to transfer their personal data to Leaseweb USA Inc, Inc as participating organization in the DPF, without the need for additional data protection safeguards. Leaseweb Canada Inc. refers to the adequacy decision applicable to Canadian commercial organization engaged in B2B activities under Canadian federal law. Customers subject to GDPR are able to transfer their personal data to Leaseweb Canada Inc. without the need for additional data protection safeguards. - EU adequacy decision for Japan
Leaseweb Japan K.K. refers to adequacy decision applicable that recognizes Japan’s data protection regime under the Act on the Protection of Personal Information (“APPI”) as providing a level of protection equivalent to that of the EU. Customers subject to GDPR are able to transfer their personal data to Leaseweb Japan K.K. without the need for additional data protection safeguards. - Standard Contractual Clauses (“SCCs”)
For EU based customers doing business with Leaseweb Sales Entities located outside of the EU without an EU adequacy decision listed above, we offer the EU Commission SCC as a lawful transfer mechanism for the customer under the GDPR.
